Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case originates in a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his return to the United States to face alien smuggling charges, he was detained in immigration custody.

In her order, the judge pointed out that the authorities lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal challenge involve conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this allegation.
